PHILADELPHIA, PA � Encore Series, Inc., presenter of Peter Nero and The Philly POPS�, today announced it has officially emerged from Chapter 11 bankruptcy protection, effective as of September 21, 2012 by ruling of The Hon. Eric L. Frank, U.S.B.J. of the United States Bankruptcy Court for the Eastern District of Pennsylvania.
�The Board of Directors of Encore Series is pleased to announce ESI has emerged from Chapter 11 bankruptcy protection. ESI is also pleased with the repayment/restructured debt terms,� said Frank Giordano, President and CEO of Encore Series, Inc. �The Philly POPS 34th annual season will be one of the orchestra�s best yet with exciting guest artists and some of the region�s most talented professional musicians led by the legendary Peter Nero.�
ESI�s Plan of Reorganization was confirmed by the United States Bankruptcy Court for the Eastern District of Pennsylvania by Order dated September 5, 2012, with an Effective Date of September 21, 2012. Through its financial reorganization, ESI restructured nearly $40 million in claims, on terms which the Bankruptcy Court found to be �fair and equitable� and feasible for The Philly POPS going forward. Payments to most classes of creditors under the Plan of Reorganization are scheduled to begin in February 2013.
